These Recruitment Terms ("Recruitment Terms") supplement the Terms of Service (B01) and apply when you use Recruitment Features to post jobs, search candidates, manage applications, use AI-assisted matching or screening tools, or otherwise participate in recruitment activity on Xila.

1. Scope and platform model
1.1 Recruitment Features include job Listings, employer and recruiter profiles, candidate profiles, CV upload, applications, messaging, interview scheduling tools, AI-assisted recommendations, screening aids and related functionality, as made available on the Platform from time to time.
1.2 Xila is designed as a technology platform and job-board style intermediary. Unless we expressly state otherwise in writing, Xila is not the employer and is not a party to employment contracts between Users.
1.3 These Recruitment Terms apply to Employers / Recruiters and Candidates.
1.4 AI features used in recruitment are also governed by the AI Services Terms (B08). Business Accounts are governed by the Business Account Terms (B02).
1.5 Capitalised terms have the meanings given in the Terms of Service unless defined here.
2. Regulatory positioning
2.1 Xila's current intended model is to provide listing, discovery, application and assistive tools. We do not currently intend to act as an employment agency or employment business that introduces or supplies workers for a fee in circumstances that trigger the Employment Agencies Act 1973 or the Conduct of Employment Agencies and Employment Businesses Regulations 2003 ("Conduct Regulations").
2.2 Product changes may change legal classification. If Xila introduces work-finding fees, candidate placement services, payroll or umbrella arrangements, temporary worker supply, or other features that resemble agency activity, additional terms, licences and compliance steps may be required. Do not rely on these Recruitment Terms alone if the product design changes.
2.3 Nothing in these Recruitment Terms constitutes legal advice on whether your own organisation requires agency registration or compliance with the Conduct Regulations.
3. Eligibility
3.1 Recruitment Features are available only to Users aged 18 or over.
3.2 Candidates must meet any minimum working age required by law for the role sought. Employers must not advertise roles that would require under-age working in breach of law.
3.3 We may require verification for certain employer accounts, high-volume posting or payout-related features.
4. Employer and Recruiter obligations
4.1 Employers and Recruiters must comply with applicable employment, equality, immigration, advertising, data protection and recruitment laws, including:
(a) the Equality Act 2010;
(b) immigration and right-to-work requirements;
(c) national minimum wage and working time rules;
(d) unlawful discrimination and harassment prohibitions;
(e) trade union and collective agreement obligations where applicable;
(f) sector-specific regulation for regulated roles.
4.2 You must have authority to recruit on behalf of the organisation named in the Listing or Account.
4.3 You are responsible for the accuracy and lawfulness of job Listings, including job title, location, duties, qualifications, salary or pay information, working patterns, sponsorship status and application instructions.
4.4 You must not charge Candidates illegal or undisclosed fees for work-finding services where prohibited by law.
4.5 If you are a recruitment business subject to the Conduct Regulations, you remain independently responsible for your compliance. Xila does not assume your agency obligations.
5. Job Listings — content standards
5.1 Job Listings must be genuine, current vacancies or clearly labelled talent pools where permitted by feature design.
5.2 Prohibited or restricted Listings include those that:
(a) unlawfully discriminate on protected characteristics or express unlawful preferences;
(b) advertise roles involving illegal activity;
(c) misrepresent employment status (for example, disguising employment as unpaid trial work where unlawful);
(d) require inappropriate personal information at application stage;
(e) promote unsafe, exploitative or deceptive working conditions;
(f) infringe intellectual property or impersonate another employer;
(g) harvest data without intention to recruit for a real role ("phantom jobs").
5.3 Pay transparency. Where UK law requires salary or rate information in job advertisements, you must include it in the Listing or in a linked disclosure as required.
5.4 We may remove or decline Listings that violate law, these Recruitment Terms or our policies.
6. Candidate obligations
6.1 Candidates are responsible for the accuracy of profiles, CVs, qualifications, employment history, right-to-work statements and application responses.
6.2 You must not impersonate another person, falsify credentials, or apply using another individual's identity or documents.
6.3 You should review job details carefully and satisfy yourself as to employer identity, role terms and safety before sharing personal data or attending interviews.
6.4 Candidates remain responsible for decisions to accept offers, resign from current roles or relocate. Xila does not guarantee employment outcomes.
7. Applications, messaging and data
7.1 When you apply or message through Recruitment Features, you consent to sharing your application materials with the relevant Employer / Recruiter through the Platform, subject to the Privacy Policy (C01).
7.2 Employers / Recruiters must use Candidate data only for lawful recruitment purposes, keep it secure, retain it no longer than necessary, and respond to data subject rights where they act as controller.
7.3 You must not export, sell or misuse Candidate data obtained via Xila, or use it for unrelated marketing without lawful permission. See Marketing Communications Policy (C10).
7.4 Sensitive personal data and criminal records information should only be collected where legally permitted, necessary for the role, and handled under appropriate conditions.
8. AI-assisted matching and screening
8.1 Xila may offer AI tools that suggest matches, rank applications, summarise CVs, draft job descriptions or assist interview scheduling.
8.2 AI outputs are advisory only. AI may be inaccurate, incomplete or biased. AI does not replace human judgment.
8.3 Human oversight. Employers and Recruiters must ensure that hiring decisions are reviewed by a human decision-maker with appropriate authority. Do not treat AI scores or recommendations as automatic rejection or selection without review, especially where decisions may significantly affect Candidates.
8.4 We do not guarantee that AI matching will identify the best Candidate or eliminate bias. Employers remain responsible for fair recruitment practices and equality law compliance.
8.5 Candidates should not rely on AI-generated feedback as definitive assessment of suitability.
8.6 Additional AI governance requirements are set out in the AI Services Terms (B08).
9. Fees and payments
9.1 Platform Fees for job posts, promotions, subscriptions or other Recruitment Features will be shown at the point of purchase or before you confirm a chargeable action, where practicable.
9.2 Payments are processed by third-party Payment Providers under the Subscription and Payment Terms (B03). Xila does not operate a wallet or escrow service.
9.3 Fees charged by Employers to Candidates for work-finding (if any) are the Employer’s responsibility and must comply with applicable law. Xila does not authorise unlawful candidate charging.
10. Non-discrimination and fairness
10.1 Employers must not use Recruitment Features to discriminate unlawfully, including through job criteria, screening questions, AI tool configuration or interview practices.
10.2 You must make reasonable adjustments in recruitment where required for disabled applicants, unless unjustified.
10.3 We may investigate reports of discriminatory Listings or conduct and take enforcement action under our policies.
11. Verification and background checks
11.1 Xila does not routinely verify every employer identity, vacancy or Candidate credential.
11.2 If you choose to conduct background, reference or DBS checks, you must comply with applicable law, including data protection and disclosure regimes. Xila does not provide regulated background checking services unless expressly stated.
11.3 Candidates should be cautious of fraudulent employers and report suspicious Listings under the Online Safety and Content Reporting Policy (C05).
12. Intellectual property
12.1 Employers warrant they have rights to post job descriptions, branding and materials in Listings.
12.2 Candidates warrant they have rights to submit CVs and portfolios.
12.3 Copyright complaints are handled under the Copyright and Intellectual Property Policy (C07).
13. Enforcement, suspension and appeals
13.1 We may remove Listings, limit applications, suspend Accounts or restrict features for breach, fraud, misleading activity, legal risk or safety concerns.
13.2 Appeals against moderation decisions are handled under the Content Moderation and Appeals Policy (C06).
13.3 We may cooperate with regulators or law enforcement where required by law.
14. Liability and disclaimers
14.1 Recruitment Features are provided "as is" and "as available" to the fullest extent permitted by law.
14.2 Xila does not guarantee hiring success, Candidate suitability, employer solvency, or accuracy of User statements.
14.3 Liability of Xila is governed by the Terms of Service. Nothing in these Recruitment Terms excludes liability that cannot be excluded by law.
14.4 Employers and Recruiters are responsible for their hiring decisions and compliance. Candidates are responsible for their applications and acceptance of offers.
15. Changes and contact
15.1 We may update these Recruitment Terms in accordance with the Terms of Service.
