These Rental Marketplace Terms ("Rental Terms") supplement the Terms of Service (B01) and apply when you use Rental Features to list, search, enquire about, offer or arrange rentals of residential or commercial property, rooms, holiday lets, vehicles, equipment or other rentable assets.

1. Scope

1.1 Rental Features include rental Listings, search and discovery, messaging, viewing arrangements, application or enquiry tools, and any payment facilitation made available for rentals, as described on the Platform from time to time.

1.2 These Rental Terms apply to Landlords (including owners, licensors and authorised letting representatives), Tenants / Renters and other Users interacting with rental Listings.

1.3 Capitalised terms have the meanings given in the Terms of Service unless defined here.

1.4 Marketplace payments and Platform Fees are governed by the Subscription and Payment Terms (B03) and Marketplace Terms (B04). If you list property or assets for rent as a provider, the Seller and Service Provider Terms (B05) may also apply where relevant.

1.5 If these Rental Terms conflict with the Terms of Service on rental-specific matters, these Rental Terms prevail for that subject matter only, to the extent lawful.


2. Xila's role — listings platform only

2.1 Xila provides technology to help Users publish and discover rental opportunities and communicate with one another. Xila is not a landlord, tenant, estate agent, letting agent or property manager unless we expressly state otherwise in writing for a specific offering.

2.2 Rental contracts are between Users. Any tenancy, licence, short-term let, hire or lease agreement is formed directly between the relevant Landlord and Tenant / Renter, not with Xila.

2.3 Xila does not:

(a) negotiate lettings on Users' behalf;

(b) collect rent as agent for Landlords;

(c) hold tenancy deposits or holding deposits;

(d) manage properties or perform inventories unless a future feature expressly states otherwise; or

(e) guarantee the condition, safety, legality, availability or suitability of any property or asset.

2.4 We do not verify every ownership claim, licence or compliance statement. Users must perform their own due diligence before entering a rental arrangement.


3. Eligibility

3.1 You must be at least 18 years old and meet Account eligibility requirements in the Terms of Service.

3.2 We may require identity or authority verification before you can publish certain rental Listings or use payout features.

3.3 Business Users letting property or assets in a commercial capacity must comply with the Business Account Terms (B02).


4. Listing requirements

4.1 Landlords and listing representatives must publish accurate, current and lawful Listings, including:

(a) property or asset description, location and material features;

(b) rent, fees, deposit requirements (if any), bills and other charges;

(c) availability, minimum term, permitted use and house rules;

(d) licensing status (for example, HMO, short-term let permissions) where applicable and known;

(e) safety and compliance information required by law or reasonably expected by Renters;

(f) contact and viewing arrangements.

4.2 You must have authority to offer the rental — for example, as owner, lawful landlord, licensee or duly appointed agent with permission to advertise.

4.3 You must promptly update or withdraw Listings when the property or asset is no longer available or material facts change.

4.4 Photographs and descriptions must fairly represent the property or asset. You must not use misleading wide-angle edits, stock images presented as actual condition, or omit material defects you know about.


5. Property rentals — legal compliance

5.1 Landlords remain responsible for compliance with applicable housing, landlord and tenant, licensing, planning, tax, immigration right-to-rent, safety and energy performance laws, including where applicable:

(a) deposit protection and prescribed information (where deposits are taken between Users);

(b) gas safety, electrical safety, fire safety and HMO standards;

(c) energy performance certificates and display requirements;

(d) selective licensing and short-term let restrictions imposed by local authorities;

(e) fair rent and tenancy deposit dispute processes where applicable.

5.2 Xila does not provide legal advice on tenancy types, notices, deposits or licensing. Users should seek independent advice where needed.

5.3 Renters should inspect properties, review documentation and confirm authority before paying deposits or signing agreements.


6. Non-property and asset rentals

6.1 Rentals of vehicles, equipment, storage, parking, tools or other assets must comply with applicable hire, road traffic, insurance, safety and ownership laws.

6.2 Providers must disclose material conditions, exclusions, insurance requirements, permitted use, return conditions and liability arrangements.

6.3 Renters are responsible for lawful use, care of the asset and return in agreed condition, subject to the contract between Users.


7. Deposits, payments and fees

7.1 No Xila deposit holding. Xila does not hold tenancy deposits, holding deposits or security deposits under these Rental Terms. Any deposit arrangements are solely between Users, unless a future product feature is expressly launched and covered by updated terms.

7.2 Where payment facilitation is enabled, payments may be processed by a regulated Payment Provider. Xila does not operate a wallet or escrow service.

7.3 Platform Fees charged by Xila will be shown at the point of purchase or before you confirm a chargeable action, where practicable.

7.4 Users are responsible for rent, deposits, bonds, invoices and tax obligations arising from their rental arrangements, except where law imposes obligations on Xila.


8. Discrimination and fair access

8.1 Listings and rental decisions must comply with the Equality Act 2010 and other applicable anti-discrimination law.

8.2 You must not publish Listings that unlawfully exclude people with protected characteristics, or use screening practices that are discriminatory, except where limited lawful exceptions apply (for example, certain shared accommodation exemptions where legally permitted).

8.3 We may remove discriminatory Listings or content that violates the Community Standards (C04).


9. Prohibited listings and conduct

9.1 You must comply with the Acceptable Use Policy (C03).

9.2 Without limitation, you must not:

(a) list property or assets you do not have authority to offer;

(b) advertise unlawful subletting or unlicensed short-term lets where prohibited;

(c) misrepresent location, price, size, occupancy limits or amenities;

(d) use rental Listings for fraud, advance-fee scams or identity theft;

(e) offer property or assets for illegal purposes;

(f) harass or exploit prospective Renters or Landlords.

9.3 Report Illegal Content or safety concerns under the Online Safety and Content Reporting Policy (C05).


10. Enquiries, viewings and contracts

10.1 Users may communicate through Platform tools or other agreed channels. You are responsible for the terms you negotiate.

10.2 Xila does not guarantee that viewings will take place or that any User will proceed to contract.

10.3 Written tenancy or hire agreements, inventories, references and checks are matters between Users unless a Platform feature expressly provides document templates labelled as non-legal advice.

10.4 AI-assisted listing or messaging tools are governed by the AI Services Terms (B08). Outputs must be reviewed before publication or reliance.


11. Cancellations and disputes

11.1 Cancellation, break clauses, refunds and forfeiture of deposits are governed by the contract between Users and applicable law, not by Xila.

11.2 If a dispute arises, Users should attempt direct resolution first. Xila may provide communication tools but is not obliged to adjudicate private disputes.

11.3 We may cooperate with Payment Providers or authorities where fraud or unlawful activity is reported, subject to law and policy.


12. Safety and risk

12.1 Landlords and providers are responsible for safe premises and assets, including required safety certificates, maintenance and hazard disclosures.

12.2 Renters should verify smoke alarms, emergency exits, gas and electrical safety documentation, and insurance cover appropriate to their use.

12.3 Xila is not responsible for personal injury, property damage or loss arising from rentals between Users, except to the extent liability cannot be excluded by law.


13. Enforcement and appeals

13.1 We may remove Listings, restrict messaging, suspend payouts or terminate Accounts for breach, fraud risk, legal requirements or safety concerns.

13.2 Appeals against moderation decisions are handled under the Content Moderation and Appeals Policy (C06).


14. Liability

14.1 Rental Features are provided "as is" and "as available" to the fullest extent permitted by law.

14.2 Xila's liability is governed by the Terms of Service. We do not warrant rental outcomes, legal compliance of Users, or accuracy of every Listing.

14.3 Nothing in these Rental Terms excludes liability that cannot be excluded by applicable law.


15. Changes and contact

15.1 We may update these Rental Terms in accordance with the Terms of Service.

12.1 Landlords and providers are responsible for safe premises and assets, including required safety certificates, maintenance and hazard disclosures.

12.2 Renters should verify smoke alarms, emergency exits, gas and electrical safety documentation, and insurance cover appropriate to their use.

12.3 Xila is not responsible for personal injury, property damage or loss arising from rentals between Users, except to the extent liability cannot be excluded by law.


13. Enforcement and appeals

13.1 We may remove Listings, restrict messaging, suspend payouts or terminate Accounts for breach, fraud risk, legal requirements or safety concerns.

13.2 Appeals against moderation decisions are handled under the Content Moderation and Appeals Policy (C06).


14. Liability

14.1 Rental Features are provided "as is" and "as available" to the fullest extent permitted by law.

14.2 Xila's liability is governed by the Terms of Service. We do not warrant rental outcomes, legal compliance of Users, or accuracy of every Listing.

14.3 Nothing in these Rental Terms excludes liability that cannot be excluded by applicable law.
